Sections

Section 76Disclosure of information between [F1Commission] and ombudsmen.

(1) The [F2Commission] may disclose to a person specified in the first column of the Table below any information obtained by, or furnished to, the [F2Commission] under or for the purposes of this Act or [F3the data protection legislation] if it appears to the [F2Commission] that the information relates to a matter which could be the subject of an investigation by that person under the enactment specified in relation to that person in the second column of that Table.

Note on the official text

In the Table in subsection (1), the words “The Scottish Public Services Ombudsman” at the end of the entry for a Local Commissioner, as published on legislation.gov.uk and reproduced above, do not belong to that entry. As enacted the entry reads “A Local Commissioner as defined by section 23(3) of the Local Government Act 1974.” The Scottish Public Services Ombudsman has an entry of its own, inserted by paragraph 23(2)(b) of Schedule 6 to the Scottish Public Services Ombudsman Act 2002, which follows in the Table. legislation.gov.uk carries the words in both places.
